Terms and Conditions
These Terms and Conditions (the "Terms") govern your use of blubirdiq.com and any related pages, forms and services operated by BlubirdIQ LLC ("BlubirdIQ", "we", "us" or "our"). By accessing the site or submitting a request through it, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site.
1. What BlubirdIQ is, and is not
BlubirdIQ is a marketing and lead generation company. We operate a website that lets homeowners request information about home equity lines of credit (HELOCs) and related home equity products, and we connect those requests with lenders, brokers and other marketing partners who may be able to help.
BlubirdIQ is not a lender, bank, credit union, mortgage broker or loan originator. We do not make loans, take applications for credit, make credit decisions, or set rates, fees or terms. Submitting a request on this site is not a loan application and does not guarantee that you will be contacted by, matched with, or approved by any lender.
2. Eligibility and accuracy
You must be at least 18 years old and a resident of the United States to use the form. You represent that the information you provide is true, complete and about you (or a person who has authorized you to act for them), and that you are the regular user of the phone number and email address you enter. Do not submit information about another person without their permission.
3. Consent to be contacted
When you submit the form you provide the consent displayed next to the submit button, which authorizes BlubirdIQ and the marketing partners listed on our partners page to contact you at the phone number and email address you provide, including by live, autodialed, prerecorded or artificial-voice calls and by text message, even if your number is on a federal, state or company do-not-call list. Message and data rates may apply. Consent is not a condition of purchasing any product or service. You may withdraw consent at any time by replying STOP to a text, telling the caller, or emailing hello@blubirdiq.com. The wording of the consent you gave, and the date and time you gave it, are kept with your request.
4. Credit authorization
If you agree to the Credit Authorization presented with the form, you authorize BlubirdIQ and its marketing partners to obtain consumer report information about you, including through a soft credit inquiry, for the purpose of determining the offers you may qualify for. A soft inquiry does not affect your credit score. A lender you choose to proceed with may later perform a hard inquiry with your separate authorization.
5. No offer, no guarantee
Rates, payment figures, loan amounts, timelines and other numbers shown on this site are illustrative estimates and are not offers, quotes, commitments or guarantees. Whether you qualify, and on what terms, is decided solely by the lender based on its underwriting, your credit, income, property, location and other factors. Products are not available in all states. Lenders and partners are independent companies and BlubirdIQ is not responsible for their products, decisions, communications or conduct.
6. How we are paid
BlubirdIQ may receive compensation from lenders and marketing partners when we provide them your request. This compensation may influence which partners receive your information and in what order. See our Affiliate Disclosure.
7. Acceptable use
You agree not to submit false, misleading or test information, to use automated tools, scripts or bots to access or submit the form, to interfere with the operation or security of the site, to copy or scrape the site, or to use the site for any unlawful purpose.
8. Intellectual property
The site, its content, design, text, graphics, logos and software are owned by or licensed to BlubirdIQ and protected by copyright, trademark and other laws. You may view the site for personal, non-commercial use only. BlubirdIQ and the BlubirdIQ bird logo are trademarks of BlubirdIQ LLC.
9. Third-party sites and services
The site may link to or load content from third parties (for example, lender websites, compliance certification services and analytics providers). Those parties have their own terms and privacy policies, which govern your use of their services. BlubirdIQ does not control and is not responsible for them.
10. Disclaimers
The site and all content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the site will be uninterrupted, error-free or secure.
11. Limitation of liability
To the fullest extent permitted by law, BlubirdIQ and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or related to your use of the site or your dealings with any lender or partner. Our total liability for any claim relating to the site will not exceed one hundred dollars ($100). Some jurisdictions do not allow these limitations, in which case they apply to the maximum extent permitted.
12. Indemnity
You agree to indemnify and hold BlubirdIQ harmless from claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the site.
13. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and by applicable federal law. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Sacramento County, California, and you consent to their jurisdiction. Nothing in this section limits rights you may have under the laws of your state of residence that cannot be waived by contract.
14. Changes
We may update these Terms from time to time by posting a revised version with a new "Last updated" date. Your continued use of the site after a change means you accept the revised Terms.
